During the three years you are allowed to be out of the United Kingdom for up to 6 months per year. You can also apply to bring your wife and children with you. The Entrepreneur visa and the millionaire investor (Tier 1) visas leave to indefinite leave after 5 years provided the immigration rules are met during that period of time. On obtaining indefinite leave to remain, you may be able to apply for British citizenship after one year provided you meet the requirements.<\/p>\n<p style=\"text-align: left;\">The requirements to be granted a visa is as follows;<\/p>\n<p style=\"text-align: left;\">1. To show from a regulated bank that you have \u00a3200,000.00 or more under your control and that this can be invested in the business;<br \/>\n2. If applying from abroad (Middle East countries, except from Turkey) in person the fee for each application is \u00a3874.00. If you are applying online or by post in the United Kingdom then the application fee is \u00a31,093 for the main applicant and a separate fee for each dependant.;<br \/>\n3. In addition to the sum of \u00a3200,000.00 there is also a separate sum to show for maintenance for yourself and each dependant. The sum of maintenance will depend on your circumstances such as if you are making the application in the United Kingdom or from abroad. You must show that you have the required sum held for a consecutive 90 days period prior to the date of your application;<br \/>\n4. There is an English language test requirement that you must meet. The test must be conducted by an approved English language test with at least CEFR level B1 in reading, writing, speaking and listening having an academic qualification that was taught in English and is recognised by UK NARIC as being equivalent to a UK bachelors degree.<\/p>\n<p style=\"text-align: left;\">On obtaining an entry clearance visa you must register as a director or as self-employed no more than six months after the date you were given permission to stay in the UK under a Tier 1 (Entrepreneur) visa. If you have permission to work before being granted an entrepreneur visa, and you can prove you have been self-employed or working as a director of a business 3 months before you apply, then you can rely on the same business shown making your application. During the course of the business, you must create at least 2 full time jobs that have existed for at least 12 months.<\/p>\n<p style=\"text-align: left;\">Administrative Review<br \/>\nIf an application is refused by the Entry Clearance officer, there is no right of appeal at the Immigration and Asylum Tribunal in the United Kingdom. Administrative review is a review by the Entry Clearance officers as to the decision made. This must be made within 28 days of receiving the refusal letter. If there is still an error of law by the entry clearance officer than this can be challenged at the High Court in the United Kingdom, by way of judicial review.<\/p>\n<p style=\"text-align: left;\">Millionaire Investors<br \/>\nThis is for those who wish to invest 1 million pounds in the United Kingdom for a period of 5 years. In this category, you must have money of your own control, in the United Kingdom amounting to not less than \u00a31 million; or have personal assets which, taking into account any liabilities to which they are subject, have a value of not less than \u00a32 million; and have money under your control and disposable in the UK amounting to not less than \u00a31 million, which has been loaned to you by a UK regulated financial institution.<br \/>\nYou must invest not less than \u00a3750,000 of your capital in the United Kingdom by way of UK Government bonds, share capital or loan capital in active and trading UK registered companies other than those principally engaged in property investment; and have invested the remaining balance of \u00a31 million in the UK by the purchase of assets or by maintaining the money on deposit in a UK regulated financial institution. The \u00a3250,000 can be invested, in for example a house\/flat. The investment must be made within 3 months of your entry into the United Kingdom, or 3 months of the date of the grant of the Tier 1 (Investor) visa. There may be cases where the investment is made before you were first granted a Tier 1 (Investor); however this should be made no earlier than 12 months before the date of the application, which led to the first grant of the visa as a Tier 1 (Investor) Migrant.<\/p>\n<p style=\"text-align: left;\">In this case there is not an English test requirement.<\/p>\n<p style=\"text-align: left;\">If this money is held for a period of 5 years or more than you may be entitled to make an application for indefinite leave to remain before their visa expires.<\/p>\n<p style=\"text-align: left;\">Questions frequently asked;<\/p>\n<p style=\"text-align: left;\">Entry Clearance<br \/>\nQ. If my embassy is closed where can I apply for entry clearance?<br \/>\nA. You may apply at the British Embassy in any neighbouring country.<\/p>\n<p style=\"text-align: left;\">Q. I have made an application to visit my family in the United Kingdom and I have been refused a visa.<br \/>\nA. Family visitors do not have a right of appeal, under the new immigration rules unless the appeal is on human rights or race discrimination grounds.<\/p>\n<p style=\"text-align: left;\">Q. I wish to visit the UK as a Business visitor. Can I apply for a visitor visa for more than 6 months?<br \/>\nA. As a business visitor, depending on the frequency of your travel, you can apply for 6 months to 5 years.<\/p>\n<p style=\"text-align: left;\">Marriage<br \/>\nQ. Can I apply for my wife to join me in the UK. I am a British citizen?<br \/>\nIf you are able to show by documentary evidence that this is a genuine and subsisting relationship, and that your wife is able to meet the maintenance and accommodation rules. Currently you must also show that you are earning \u00a318,600 p\/a or more by way of payslips and bank statements. Your wife will also have to meet the English test requirement.<\/p>\n<p style=\"text-align: left;\">EU Law<br \/>\nQ. I have been married to a European man for over 3 years. If I leave him will my visa be curtailed?<br \/>\nA. If you can show that your European husband has been in employment in the United Kingdom since you were married, then once you are divorced you may make an application under EU Law to retain EU rights. This means you will be granted a 5 years residence permit.<\/p>\n<p style=\"text-align: left;\">Family Reunion<br \/>\nQ. I have been granted refugee status and I wish to bring my wife and children.<br \/>\nA. You will have to make an application for entry clearance for each member of the family. You do not have to meet the maintenance and accommodation rule as existing families are exempt from these rules.<\/p>\n<p style=\"text-align: left;\">Q. My mother is over 65 years of age and a widow. I used to live and support her in Iraq. Now she has no one living with her. I am working and not in receipt of benefits. Can I apply for her to join me in the UK?<br \/>\nA. As you are a recognised refugee, you can apply for family reunion if you can show that you had lived with your mother before entering the United Kingdom and that you have continued to support her while you were here. You must show that she was wholly or mainly financially dependant on you. You must also show there are exceptional circumstances involved and that she has no other relative to look after her in her country. If there is medical evidence to support her case, for example you should also rely upon this. You should also she you are able to maintain and accommodate her in the UK.<\/p>\n<p style=\"text-align: left;\">Student Visas<br \/>\nQ. What are the common reasons for the Home Office refusing to an application to extend student visa.<br \/>\nA. One of the common reason is that the college is not licensed or their licence has been revoked. This licence is obtained from the Home Office. A second reason may be that the student has failed to attend their course on a regular basis.<\/p>\n<p style=\"text-align: left;\">Naturalisation<br \/>\nQ. I have a baby. I have indefinite leave to remain. Does my child have to apply to the Home Office for naturalisation\/registration?<br \/>\nA. If you hold indefinite leave, or that you are a British citizen at the time the child was born, your child is British. You simply complete a United Kingdom application form on behalf of your child and forward the required supporting documents.<\/p>\n<p style=\"text-align: left;\">If you are residing abroad, the application is not made at the British Embassy abroad but at the Home Office in the United Kingdom.<\/p>\n<p style=\"text-align: left;\">Asylum Claims<br \/>\nQ. Can I apply for permission to work if I am an asylum seeker?<br \/>\nA. If your initial asylum claim has been pending for one year or more then you may apply for permission to work. You must make an application to the Home Office and wait for the permission to be granted. However an asylum seeker is only allowed to be engaged in employments that fall under the Shortage Occupation List. Therefore the right of employment is limited.<\/p>\n<p style=\"text-align: left;\">Q. I made an application for permission to work 6 months ago, and my asylum claim has been pending over 1 year ago. The Home Office did not consider my application and this has made me destitute and I am still waiting.<br \/>\nA. You can write to the Home Office a letter asking them to consider your case within a specific time. The Home Office will only prioritise case, which has compassionate circumstances. If your case falls within this category, and you can show there is a breach of your human rights such as your article 8 right(private or family life), then you should first put this in writing and submit this to the Home Office. You should give the Home Office a deadline to reach a decision. You should also submit medical evidence for example to show the compassionate circumstances. The medical report must be very detail and from a medical specialist, and confirms how the delay ahs affected that person\u2019s health.<\/p>\n<p style=\"text-align: left;\">Children<br \/>\nQ. My children are British who is settled in the UK, and I am divorced from my wife. Can I stay in the UK because of my children?<br \/>\nA. You can make an application under the immigration rules known as Access to Children. You must meet the requirements, which also includes that you must show that you will contribute towards the upbringing of the children. You will have to show an agreement between yourself and your ex-wife that she consents to the contact and you being involved in the up bring of the child. You must also show that you are able to maintain and accommodate yourself without recourse to public funds.<\/p>\n<p style=\"text-align: left;\">Q. What if she does not consent to contact and the agreement?<br \/>\nA. You will have to obtain a Contact Order from the family court. You will also have to show your earnings, that you will be able to maintain and accommodate yourself in the UK and contribute towards the child\u2019s upbringing in addition to other requirements.<\/p>\n<p style=\"text-align: left;\">Disclaimer: The advice given above is general advice.
