Bahrain\u2019s detention of activist Nabeel Rajab is unlawful and violates his right to freedom of expression, U.N. human rights experts have found, calling on the kingdom to release him immediately with compensation.<\/strong><\/p>\n

There was no immediate reaction from Bahraini authorities to the appeal by the U.N. Working Group on Arbitrary Detention, which said the government had not responded to its requests for information on the high-profile case.<\/strong><\/p>\n

Bahrain, where a Sunni Muslim royal family rules over a Shi\u2019ite-majority population, has cracked down on perceived threats since Arab Spring protests in 2011, led mainly by Shi\u2019ites, were quashed with the help of Gulf Arab neighbors.<\/p>\n

Rajab was sentenced to five years in prison in February for criticising Saudi Arabia\u2019s air strikes in Yemen and writing tweets accusing Bahrain\u2019s prison authorities of torture.
\nA leading figure in the pro-democracy protests, he was already serving a two-year term over a news interview in which he said Bahrain tortured political prisoners.<\/p>\n

In a formal opinion posted overnight, the U.N. panel of five independent experts said that provisions of Bahrain\u2019s penal code were \u201cso vague and overly broad\u201d that people were punished for merely exercising their rights under international law.<\/p>\n

\u201cThe Working Group therefore considers that Mr. Rajab\u2019s deprivation of liberty is arbitrary,\u201d it said, adding that: \u201cno such trial\u201d should have taken place.<\/p>\n

It considered that Rajab\u2019s political views were \u201cclearly at the center of the present case and that the authorities have<\/strong><\/p>\n

displayed an attitude towards him that can only be characterized as discriminatory; indeed, he has been the target of persecution, including deprivation of liberty, for many years and there is no other explanation for this except that he is exercising his right to express such views and convictions.\u201d<\/p>\n

Rajab, held since June 2016, should be released immediately and compensated, it said.<\/p>\n

The opinions of the panel are based on national obligations under international human rights law that they have ratified and are thus legally-binding in nature, it says.<\/p>\n

Separately, the U.N. Human Rights Committee called last month for Bahrain to release activists including Rajab.<\/p>\n

The United States, which has a major naval base in the country, has expressed concern about his case.<\/p>\n

Sayed Ahmed Alwadaei of the London-based Bahrain Institute for Rights and Democracy, said in a statement: \u201cThe U.N. has now unequivocally found that Bahrain is arbitrarily detaining Nabeel Rajab in violation of numerous international legal standards \u2013 these vital findings cannot be ignored\u201d.<\/p>\n

He called for Bahrain\u2019s allies, including Britain, to back the call for his release, adding: \u201cAnything short of that is a tacit endorsement Bahrain\u2019s patently criminal behavior.\u201d<\/p>\n
